Habitstone Terms of Service

These Terms of Service ("Terms") are an agreement between you and Habitstone LLC("Habitstone," "we," "us," or "our"). They govern your use of the Habitstone mobile application, website, cloud backup, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old, or the minimum age required to use the Service in your country. If you are not old enough to enter into a binding agreement, a parent or legal guardian must review and agree to these Terms for you.
The Service
Habitstone provides tools for creating and tracking habits, recording progress, pairing supported NFC items, receiving reminders, viewing widgets or Live Activities, creating shareable streak cards, and optionally backing up certain progress through Sign in with Apple.
Habitstone is a general wellness and productivity tool. It is not medical care, medical advice, diagnosis, treatment, or an emergency service. Do not disregard professional advice or delay seeking it because of information in the Service. If you have a medical emergency, contact local emergency services.
We may add, change, suspend, or discontinue features. We do not guarantee that the Service, cloud backups, notifications, NFC features, widgets, or third-party integrations will always be available, error-free, or compatible with every device.
Your account and data
You may use core features without creating a cloud account. If you enable Apple backup, you are responsible for maintaining control of your Apple Account and device. You must provide accurate information and promptly notify us if you believe your account or backup has been accessed without permission.
You are responsible for maintaining your own copies of information that is important to you. Cloud backup is provided as a convenience and is not guaranteed to prevent data loss. You can disconnect your account or delete your backup and account using the controls available in the app.
Our collection and use of information is described in the [Habitstone Privacy Policy](https://habitstone.app/privacy), which is incorporated into these Terms by reference.
Your content
You retain ownership of the habit text, names, entries, images, and other content you provide or create through the Service ("Your Content"). You give Habitstone a limited right to process Your Content only as needed to operate, secure, support, and improve the Service as described in the Privacy Policy.
You are responsible for Your Content and for anything you choose to share outside Habitstone, including streak cards. Do not submit or share content that is unlawful, infringes another person's rights, or contains malicious code.
Acceptable use
You may not:
- Use the Service in violation of applicable law or another person's rights
- Attempt to gain unauthorized access to the Service, another account, or related systems
- Interfere with, disrupt, damage, or overload the Service
- Reverse engineer, copy, modify, or redistribute the Service except where applicable law expressly permits it
- Use automated means to scrape or extract data from the Service
- Misrepresent your identity or use the Service to harass, deceive, or harm anyone
We may investigate suspected misuse and restrict or terminate access where reasonably necessary to protect users, Habitstone, or others.
Ownership and license
Habitstone and its licensors own the Service, including its software, design, text, graphics, trademarks, and other materials, excluding Your Content. Subject to these Terms, Habitstone grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose on devices you own or control.
The app is licensed, not sold. If you download it through Apple's App Store, your license is also subject to Apple's applicable Usage Rules and [Standard Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
Third-party services
The Service may rely on or link to services provided by Apple, Supabase, and other third parties. Their services are governed by their own terms and policies. Habitstone is not responsible for third-party services, content, availability, or actions. Your mobile carrier or other provider may charge fees for data or connectivity.
Feedback
If you send ideas or feedback, you allow Habitstone to use them without restriction or compensation. This does not transfer ownership of Your Content or personal information to us.
Suspension and termination
You may stop using the Service at any time. You may delete an optional cloud backup and account from within the app. Deleting the app may remove locally stored data that has not been backed up.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or if we discontinue the Service. Where reasonable, we will provide notice. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and dispute provisions.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Habitstone disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and uninterrupted availability. Habit tracking results vary, and we do not promise that using Habitstone will create or maintain any habit or produce a particular outcome.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms limits non-waivable consumer rights.
Limitation of liability
To the maximum extent permitted by law, Habitstone LLC and its members, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities, arising from or related to the Service.
To the maximum extent permitted by law, Habitstone's total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amount you paid Habitstone for the Service during the 12 months before the event giving rise to the claim or (b) US $100.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
Governing law and disputes
These Terms are governed by the laws of the state in which Habitstone LLC has its principal place of business, without regard to conflict-of-law principles, except where the law where you live requires otherwise. Before filing a formal claim, you and Habitstone agree to try to resolve the dispute informally by contacting the other party and allowing 30 days for a response. Any dispute that is not resolved informally will be brought in a court with jurisdiction where Habitstone LLC has its principal place of business, unless applicable law gives you the right to bring it elsewhere. These Terms do not require arbitration and do not prevent either party from seeking relief in small claims court where eligible.
Changes to these Terms
We may update these Terms as the Service or applicable requirements change. We will update the effective date and provide additional notice when required. If a material change applies to your continued use of the Service, we may ask you to accept the updated Terms. Continuing to use the Service after updated Terms take effect means you accept them to the extent permitted by law.
General terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Habitstone may transfer them as part of a merger, acquisition, reorganization, or sale of assets. These Terms, together with the Privacy Policy and any terms presented for a specific feature, are the entire agreement between you and Habitstone regarding the Service.
